These Terms of Use (“Terms”) govern your access to and use of www.kinship-creative.com (the “Site”), which is owned and operated by Kinship Creative LLC (“Kinship Creative,” “we,” “us,” or “our”).
 

Please read these Terms carefully. By accessing or using the Site, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, do not use the Site.


Purpose of the Site

The Site provides information about Kinship Creative, its website design, brand design, marketing, consulting, educational resources, digital products, and related services.

The information on the Site is provided for general informational and educational purposes. Visiting the Site, submitting an inquiry, scheduling a discovery call, or downloading a free resource does not create a client, advisory, fiduciary, or confidential relationship between you and Kinship Creative.
 

A client relationship is created only after both parties enter into a written Client Agreement and any required initial payment has been received.
 

Eligibility

  • You must be at least 18 years old and have the legal authority to agree to these Terms.

  • If you access or use the Site on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.

  • You may not use the Site if doing so would violate the laws or regulations that apply to you.

 

Privacy

Your use of the Site is also subject to our Privacy Policy, which explains how we collect, use, store, and disclose personal information.

Please review the Privacy Policy available on the Site.
 

Electronic Communications

When you contact Kinship Creative, submit an inquiry, make a purchase, or otherwise communicate with us electronically, you consent to receive service-related communications electronically. These may include responses to inquiries, proposals, contracts, invoices, purchase confirmations, download instructions, project communications, and legal notices.

Marketing emails are optional. You may unsubscribe from promotional emails at any time by using the unsubscribe link included in the email or contacting us at kari@kinship-creative.com. Unsubscribing from promotional emails will not prevent us from sending transactional, contractual, project-related, or other service communications.


User Accounts

Certain current or future Site features may allow you to create an account or access protected content.
 

If you create an account, you are responsible for:

  • Providing accurate and current information

  • Maintaining the confidentiality of your password and login information

  • Restricting access to your account and devices

  • All activity conducted through your account

  • Notifying us promptly if you suspect unauthorized access

  • You may not transfer, sell, share, or assign your account to another person without written permission.


We may suspend or terminate an account if we reasonably believe it has been compromised, misused, or used in violation of these Terms.


Permitted Use

Subject to these Terms, Kinship Creative grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for lawful personal or internal business purposes.

This license does not transfer ownership of the Site or any of its content to you.


Prohibited Use

You agree not to:

  • Use the Site for an unlawful, fraudulent, abusive, or deceptive purpose

  • Attempt to gain unauthorized access to the Site, another user’s account, or a connected system

  • Interfere with the operation, security, performance, or availability of the Site

  • Introduce viruses, malware, malicious code, or other harmful technology

  • Circumvent access controls or security measures

  • Copy, reproduce, republish, distribute, sell, sublicense, or commercially exploit Site content without permission

  • Remove or alter copyright, trademark, attribution, or proprietary notices

  • Misrepresent your identity or affiliation with Kinship Creative

  • Impersonate Kinship Creative, its owner, representatives, or clients

  • Collect personal information about other visitors without authorization

  • Use automated tools to scrape, extract, harvest, or download Site content in bulk

  • Use Site content to create a competing product, service, template, course, resource library, or educational offering

  • Use Site content to train, test, develop, or improve an artificial intelligence or machine-learning model without written permission

  • Encourage or assist another person in violating these Terms

Ordinary indexing by legitimate search engines and AI-enabled search services is permitted when performed in accordance with our technical instructions, robots settings, and applicable permissions.


Intellectual Property

The Site and its original content are owned by Kinship Creative LLC or used with permission.


Protected content may include:

  • Website copy

  • Blog posts and educational articles

  • Workbooks, guides, checklists, and downloads

  • Graphics, illustrations, and photographs

  • Website layouts and design elements

  • Videos, audio, and presentations

  • Logos, brand marks, names, and taglines

  • Templates, frameworks, systems, and processes

  • Course or workshop materials

  • Digital products

  • The arrangement and compilation of Site content

This content is protected by copyright, trademark, and other intellectual-property laws.
 

KINSHIP CREATIVE, Kinship Creative’s logos, taglines, and related brand elements are trademarks or proprietary marks of Kinship Creative LLC. Nothing in these Terms grants permission to use those marks without prior written authorization.

The Site may also display client-owned or third-party materials with permission. Ownership of those materials remains with the applicable owner.
 

Digital Products and Resources

Kinship Creative may offer free or paid digital resources, including workbooks, guides, checklists, templates, downloads, educational materials, or other digital products.
 

Unless a product page or separate license states otherwise, your purchase or download grants you a limited, non-exclusive, non-transferable, revocable license to use the product for your own personal use or the internal use of one business.


You may not:

  • Share the product with another person or business

  • Upload it to a shared resource library

  • Sell, sublicense, distribute, or give away the product

  • Reproduce it for clients, students, members, or customers

  • Remove Kinship Creative branding, copyright notices, or attribution

  • Present the product or its contents as your own work

  • Convert it into a course, workshop, membership resource, lead magnet, or competing product

  • Use it to train or develop an artificial intelligence system

  • Use the product outside the license provided at purchase
     

Templates or other products may include a separate license agreement. If a separate product license conflicts with this section, the product-specific license will control.


Purchasing a digital product does not transfer its copyright or ownership to you. You may not alter purchased templates to share or claim ownership or sell.


Digital Product Purchases and Refunds

Prices, product descriptions, license terms, and payment requirements will be displayed on the applicable product or checkout page.

We reserve the right to:

  • Change product prices before purchase

  • Correct pricing or description errors

  • Modify or discontinue a product

  • Refuse or cancel an order affected by fraud, a technical error, or an incorrect price
     

Because digital products can be accessed, downloaded, or copied immediately, sales of digital products are final once access or delivery has been provided, except when a different refund policy is stated on the product page or a refund is required by law.

Client Services and Commercial Terms

Descriptions of services on the Site are provided for general information and do not constitute a binding offer, guaranteed availability, or promise to provide services.

Before beginning a client project, you may receive a customized proposal, scope of work, Client Agreement, invoice, or other written terms. You are responsible for reviewing those documents before signing or submitting payment.
 

Service pricing, deposits, payment schedules, deliverables, revisions, timelines, cancellations, refunds, intellectual-property rights, confidentiality obligations, and project responsibilities are governed by the applicable Client Agreement. If these Terms conflict with a signed Client Agreement concerning client services, the signed Client Agreement will control. Prices displayed or discussed on the Site may change at any time. Pricing changes will not alter the terms of an already signed Client Agreement unless permitted by that agreement or agreed to in writing.
 

Recurring Services and Subscriptions

Kinship Creative may offer recurring services, subscriptions, memberships, support plans, or automatically renewing products in the future.

  • When an offer automatically renews, the applicable purchase page or agreement will disclose:

  • That the purchase will continue or renew until canceled

  • The amount and frequency of recurring charges

  • The length of the renewal term

  • The cancellation procedure

  • Any minimum commitment

  • Any trial or promotional period

  • When and how pricing may change

Recurring charges will not begin without the customer’s affirmative consent to the applicable renewal terms.
 

If a subscription is accepted online, an online cancellation method will be provided as required by applicable law. Cancellation generally stops future renewals and does not create a retroactive refund for a period that has already been paid, except when stated otherwise or required by law.


Client support plans and service retainers may instead be governed by a separate Client Agreement. When a separate agreement applies, that agreement will control.


User Submissions

You may provide information through forms, surveys, applications, comments, emails, testimonials, feedback, or other submissions.

You represent that:

  • You have the right to provide the submitted material

  • The material is accurate to the best of your knowledge

  • The material does not violate another person’s intellectual-property, privacy, publicity, or contractual rights

  • The material does not contain unlawful, defamatory, threatening, or malicious content

  • You retain ownership of materials you submit.


By submitting materials that are necessary for us to respond to an inquiry, complete a purchase, or provide requested services, you grant us a limited license to use those materials for that purpose. We will not publicly use your name, testimonial, project materials, photographs, or business content for promotional purposes unless you have authorized that use, including through a Client Agreement, release, or other written permission. General suggestions or feedback about Kinship Creative, the Site, or our offerings may be used to improve our business without compensation or attribution.

 

Do not submit confidential or highly sensitive information through a public form. Sending unsolicited information does not create a confidential or client relationship.


Third-Party Websites and Services

The Site may contain links to third-party websites, platforms, products, or services. These may include social media platforms, payment providers, scheduling tools, client websites, referral partners, or other outside resources.
 

Kinship Creative does not own or control these third parties and is not responsible for:

  • Their content, availability, accuracy, or security

  • Their privacy or data practices

  • Purchases or transactions made through them

  • Losses or damages resulting from their use


A link does not necessarily mean that Kinship Creative endorses or is affiliated with the third party. Your use of a third-party platform is governed by that provider’s terms and privacy policy.


Educational Information and No Professional Advice

The Site may include educational content concerning websites, branding, marketing, search engine optimization, artificial intelligence visibility, customer experience, business strategy, or related topics. This information is general and educational. It is not legal, accounting, tax, financial, medical, or other regulated professional advice. You are responsible for evaluating information and obtaining advice from an appropriately qualified professional when necessary. Nothing on the Site creates a guarantee that a particular strategy is suitable for your business.


No Guarantee of Results

Kinship Creative does not guarantee:

  • Search engine rankings

  • Placement or visibility in artificial intelligence-generated search results

  • Website traffic

  • Leads, inquiries, sales, or revenue

  • Business growth or profitability

  • Social media reach or engagement

  • Conversion rates

  • Media coverage, awards, or public recognition

  • Any particular business, marketing, or creative outcome
     

Results depend on many factors outside Kinship Creative’s control, including your industry, location, competition, budget, participation, market conditions, search algorithms, platform policies, consumer behavior, and implementation.

Testimonials and case studies describe the experiences of particular clients. They do not promise or guarantee that another person or business will receive the same result.
 

Site Availability and Changes

We may modify, update, suspend, restrict, or discontinue all or part of the Site at any time.
 

We do not guarantee that:

  • The Site will always be available or uninterrupted

  • The Site will be completely secure or error-free

  • Information will always be current or complete

  • All links or features will continue to function

  • Defects will always be corrected immediately
     

We may correct errors, update content, and change Site features without prior notice.

Accessibility
 

Kinship Creative is committed to making the Site accessible and usable for a broad audience, including people with disabilities. We take reasonable steps to identify and address accessibility barriers as part of our ongoing website maintenance.

Because technology and accessibility needs continue to evolve, some content, features, or third-party integrations may not operate as intended with every browser, device, or assistive technology.

Disclaimer of Warranties

To the maximum extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis.
 

Kinship Creative makes no express or implied warranties regarding the Site or its content, including warranties of:

  • Accuracy

  • Completeness

  • Reliability

  • Availability

  • Merchantability

  • Fitness for a particular purpose

  • Title

  • Non-infringement

  • Security

  • Compatibility with a particular device or system


Some jurisdictions do not allow certain warranty exclusions. Where those laws apply, these exclusions will apply only to the extent legally permitted.
 

Limitation of Liability

To the maximum extent permitted by law, Kinship Creative LLC and its owner, employees, contractors, representatives, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:

  • Your access to or use of the Site

  • Your inability to access or use the Site

  • Reliance on Site content

  • Errors or omissions

  • Loss of data, profits, revenue, business opportunities, goodwill, or reputation

  • Third-party websites or services

  • Unauthorized access, malware, or other security incidents outside our reasonable control

  • A digital product or resource
     

To the maximum extent permitted by law, Kinship Creative’s total liability arising from your use of the Site or a digital product will not exceed the greater of:

The amount you paid Kinship Creative for the specific digital product giving rise to the claim during the six months preceding the event; or One hundred U.S. dollars. This limitation does not apply to liability that cannot legally be limited or excluded. Liability arising from contracted client services is governed by the applicable Client Agreement.


Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Kinship Creative LLC and its owner, employees, contractors, and representatives from third-party claims, liabilities, damages, judgments, costs, and reasonable attorneys’ fees arising from:

  • Your unlawful or unauthorized use of the Site

  • Your violation of these Terms

  • Materials you submit

  • Your infringement of another person’s intellectual-property, privacy, publicity, or other rights

  • Your misuse, resale, or unauthorized distribution of a digital product

  • Your violation of an applicable law or regulation


We reserve the right to assume control of the defense of a claim subject to indemnification. If we do, you agree to cooperate reasonably with the defense.


Suspension and Termination

We may restrict, suspend, or terminate your access to the Site, an account, a protected resource, or a digital product if we reasonably believe that you:

Violated these Terms
Misused Kinship Creative’s content or intellectual property
Engaged in fraudulent, abusive, or unlawful activity
Created a security risk
Failed to pay an amount properly due
Used the Site in a manner that could harm Kinship Creative or another person

Termination does not eliminate obligations that arose before termination. Provisions concerning intellectual property, digital-product restrictions, disclaimers, liability, indemnification, and dispute resolution will survive.

Termination of contracted client services is governed by the applicable Client Agreement.


International Users

The Site is operated from California, United States. If you access the Site from outside the United States, you are responsible for complying with the laws that apply in your location. You may not use the Site or its content in a country or manner prohibited by applicable laws or regulations.


Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

To the extent permitted by law, any dispute arising from or relating to the Site or these Terms must be brought in the state courts located in Ventura County, California, or the applicable federal court within the United States District Court for the Central District of California. You consent to the personal jurisdiction and venue of those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any dispute concerning contracted client services will be governed by the dispute-resolution provisions in the applicable Client Agreement.


Changes to These Terms

We may update these Terms to reflect changes to the Site, our offerings, our business practices, or applicable laws.

When we make changes, we will post the revised Terms on this page and update the “Last Updated” date. Material changes will apply prospectively unless otherwise required by law. Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Site.


General Provisions

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified or limited to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision does not waive our right to enforce it later. You may not assign or transfer your rights under these Terms without our written permission. We may assign these Terms as part of a merger, sale, reorganization, or transfer of the business. These Terms do not create a partnership, joint venture, employment, agency, fiduciary, or franchise relationship.


These Terms, together with the Privacy Policy and any policies expressly incorporated by reference, constitute the agreement between you and Kinship Creative concerning use of the Site.
 

A signed Client Agreement or product-specific license may create additional terms and will control within its respective scope.
